AFFIDAVIT OF LEASE TERMINATION AND NON-EFFECT

L, the undersigned, as an authorized officer of 2437 KANE, LLC, a Delaware limited
liability company (“Vested Owner”) of that certain real property more fully described in
Exhibit A attached hereto (the “Propertv”), being first duly sworn, depose and state as follows.

WITNESSETH:
1. Ownership of the Property. Vested Owner is the current fee owner of the Property.

2. Prior Lease Terminated and of No-Effect. That certain unrecorded lease (the
“Lease”) affecting the Property, made a matter of record pursuant to that certain Memorandum of
Master Lease Agreement, dated as of July 11, 2005, by and between LTC Properties, Inc., as
landlord and Assisted Living Concepts, Inc., Carriage House Assisted Living, Inc., and
Extendicare Health Services, Inc., as tenant (collectively, the “Named Tenants”), recorded in the
official records of Klamath County, Oregon, as Recording No. Volume MO05, Page 60670, is no
longer in force or effect and has been terminated, expired or otherwise extinguished. The Named
Tenants are no longer tenants of the Property and have vacated the Property.

3. No Revival. Vested Owner disclaims any intent to recognize, reinstate, or revive
the Lease, and any such Lease shall be null and void and of no further force and effect.

4. Purpose. This Affidavit is made for the purpose of confirming the termination and
non-effect of the Lease and to include title companies, lenders and other interested parties to rely
upon the foregoing.

IN WITNESS WHEREOF, the Vested Owner has executed this Affidavit as of March 24,
2026.
